Terms of Service

1. Acceptance & Eligibility

By using TwoTop.app (the "Service"), operated by Digital Macaroni, you agree to these terms. You represent that you are an owner, employee, or authorized agent of the business entity (the "Restaurant") for which you are creating an account.

2. The "Social Media OS" Service

TwoTop is an AI-powered automation suite. You acknowledge that:

• AI Outputs: The Service uses Large Language Models (LLMs) and computer vision. While we strive for accuracy, AI-generated content (captions, images) may occasionally contain "hallucinations" or inaccuracies. You are responsible for reviewing content before it is published.
• Third-Party Dependencies: Our ability to post to social media depends on the APIs of third parties (e.g., Meta, TikTok). We are not liable for service interruptions caused by these platforms or for any changes to their terms that may impact your account.

3. Credits, Billing, and Polar Integration

TwoTop operates on a subscription and credit-based model:

• Credit Consumption: Actions like image generation or complex analysis consume credits at the rates disclosed in the Dashboard.
• Billing: All financial transactions are handled via Polar. Subscriptions auto-renew unless canceled.
• Refunds: Credits are considered "consumed" once used to generate content. We do not offer refunds for "hallucinated" AI content that meets the technical request but does not satisfy your personal preference.

4. Intellectual Property & AI Governance

• Your Inputs: You retain ownership of all original photos and menu data uploaded. You grant TwoTop a worldwide, non-exclusive license to use this data to provide and improve the Service for your Restaurant.
• The Output: Crucially, Digital Macaroni grants you ownership of the final AI-generated "Output" (captions and images) for use in your business. However, you acknowledge that AI-generated content may not be unique across users (e.g., two restaurants with identical menus may receive similar AI captions).
• Our Platform: The software, interface, and proprietary "prompt engineering" logic remain the sole property of Digital Macaroni.

5. Account Stewardship & Social Tokens

• Security: You are responsible for the security of your account. We treat "Social Tokens" (the links to your IG/FB) as sensitive data and encrypt them at rest, but you must ensure your own password hygiene.
• Authorized Posting: By connecting your social accounts, you grant TwoTop permission to post content to those platforms on your behalf based on the schedules you create.

6. Acceptable Use (The "No-Hate" Clause)

You agree not to use TwoTop to generate or distribute content that is:

• Illegal, discriminatory, or promotes hate speech.
• Infringing on the trademarks or copyrights of other restaurants or brands.
• "Spammy" in a way that violates Social Media Platform Community Guidelines.

7. Termination of Service

Digital Macaroni reserves the right to suspend accounts that violate these terms or fail to maintain a valid payment method. Upon termination, your right to access the Service and your library of scheduled content ceases immediately.

8. Disclaimer of Warranties ("As-Is")

TwoTop is provided "As-Is." We do not guarantee that the Service will be 100% error-free or that social media posts will always be delivered on time (due to the inherent instability of third-party APIs). Our total liability for any claim is limited to the amount you paid us in the past 12 months.
